Terms and Conditions:
Please read the following terms carefully as they form an agreement between you and Freshworks, Inc., including its Affiliates (“Freshworks”) for the purposes of this online contest at https://freshdesk.com/customer-service-representative/customer-service-week-2018-blog/ (“Contest”).
Communication from us:
You hereby agree to receive communication from us in relation to the Contest and/ or for collecting further information.
Ownership of Intellectual Property:
You acknowledge and agree that you are either the owner of the content posted as part of the Contest (including without limitation, the memes and/ or pictures submitted by you) or you have the necessary licenses from the owners of the such content to use, modify, tweet, post or otherwise deal with such content for the purposes of this Contest. You also acknowledge and agree to provide (where you are the owner) or to secure for Freshworks from the owner (where you are not the owner) the license to display and distribute such content for marketing, promotional and other purposes. Freshworks claims no ownership rights over such content.
Freshworks’ Liability:
You agree that in any given instance, the maximum aggregate liability of Freshworks under these terms shall not exceed $100 (One-Hundred US Dollars).
Indemnity:
You agree to hold Freshworks harmless against any notices, claims, actions, causes of action, legal proceedings and further indemnify Freshworks against damages, fines, expenses, court costs, attorney fees, liability, damage or judgment suffered by Freshworks resulting from or attributable to any breach of these terms or to your participation in the Contest.
Governing Law and Jurisdiction:
Your participation in the Contest and these terms shall be governed by the laws of the State of California without regard to conflict of laws principles. You hereby agree to submit to the exclusive jurisdiction of the competent courts in the State of California in respect of any dispute arising out of or in connection with these terms.
